In short

Free for open-source projects and for companies with under €1M yearly revenue, including in production. Anyone can evaluate and develop with it for free. Other companies buy one commercial licence per company, per major version: it never expires and has no limits on developers, apps or users. Add-on packs are included.

This licence covers JBay Floorplan: the @jbaysolutions/floorplan-* packages (including the add-on packs) and their documentation (together, "the Software"). "We" and "JBay Solutions" mean JBay Solutions, the author of the Software. "You" means the person or company using it.

1. Free licence

You may use the Software free of charge, in production, for any purpose if either:

• you're an open-source project: the Software is used in a project whose source code is published under a licence approved by the Open Source Initiative; or
• you're small: your company (or you, as an individual) had less than €1,000,000 in revenue in its last financial year. Revenue includes that of any company that controls yours, is controlled by yours, or is under common control with yours.

2. Trying it out

Anyone may use the Software free of charge to evaluate it, and to develop and test with it. Using it in production requires a free licence (section 1) or a commercial licence (section 3).

3. Commercial licence

If you don't qualify for the free licence, you need a commercial licence to use the Software in production.

• One licence per company. It covers one company (one legal entity) and everyone who works for it, with no limit on developers, applications, websites, buildings, floors or users.
• One licence per major version. It covers the major version you bought (for example 2.x), including every minor and patch release of it. It never expires. A later major version (for example 3.x) needs a new licence.
• The price and how to buy are on our website. Your licence starts when you've paid.

4. What either licence covers

• Your own applications and websites: you may use the Software in them, and ship it inside them to your users (for example, in the JavaScript bundle of a website or app).
• Work for other companies: if you build an application or website for another company, that company needs its own licence (free or commercial) for it.
• Products sold to other companies (OEM): including the Software in a product or developer kit that other companies install or build their own applications with needs a separate agreement with us. Contact us.
• Add-on packs are included in every licence at no extra cost.

5. Growing past the free licence

If your revenue reaches €1,000,000 or more, you have 90 days from the end of that financial year to buy a commercial licence. You can keep using the Software during those 90 days.

6. What you may not do

• Sell, sublicense or distribute the Software on its own, or as a component library, toolkit or development kit for others, except as allowed in section 4.
• Remove or change copyright notices or this licence in the Software.
• Use the Software to build a product that competes with it (a floor plan editor or viewer library for other developers).

You may change the Software for your own use. Changed versions are covered by this licence in the same way.

7. Support

Neither licence includes support. Support is available separately (Premium Support) and is described on our website.

8. No warranty

The Software is provided "as is", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, JBay Solutions is not liable for any damage or loss of any kind arising from the Software, its use or this licence, whether direct or indirect, including loss of profit, revenue, data or business. You use the Software at your own risk.

This does not exclude liability that the law does not allow to be excluded: for intentional misconduct or gross negligence, for death or personal injury, or under consumers' mandatory rights.

10. Ending the licence

If you break this licence and don't put it right within 30 days of our written notice, your licence ends and you must stop using the Software in production. Otherwise, licences don't end.

11. Law

This licence is governed by the laws of Portugal. The courts of Lisbon, Portugal, have exclusive jurisdiction over any dispute, except where mandatory law gives you the right to use the courts where you live.
